Title: Foot will now be a pin cushion

I had someone pull out on me today and pull in to the left lane, then as I went to go around they pulled in to the right getting out of my way only to put themselves in it, then as I went back they went back.  I ended up avoiding them and going on the sidewalk and bailing just before the bike put itself under a parked truck.  Son of a pregnant dog.  I got up and fell right back down, since I broke 4 bones in my foot.  Gear held up great though and I probably would have mangled slop for a foot if it hadn't been for the Oxtars.  I would be pretty banged up if I didn't have my stuff.  No other part of me was hurt, just some little bones in my feet and a nice down to the bone gash in my shin, but I didn't cut my pants so I don't know what that is from.  I also don't know what or when in the accident I hit my foot.  and I had just changed the back tire.

I couldn't tell whether it was make the beast with two backsed or not.  The triple clamp came off and the stock mufflers are toast.  The tank looked fine though.  It may not be too bad and at the very worst if there is a low buy back I should be able to part it out and do pretty well.

That really blows.  It worries me that the cager could drive away because, even though he caused the crash, he didn't actually contact you.  Hopefully he stopped, but it doesn't sound like it from your original post.  Heal up well.

No, he stopped and was cited for the accident.  So I have that going for me.  He tried to say I was flying @ 80 down a city road, so he is fighting the citation.  I had an eyewitness and common sense on my side.  I stopped rolling only a car length from where I jumped off, and had just passed a cop citing someone.  Oh and I barely have any other scratches on me.  That and I mostly ride like a sissy.  So I don't really see it being an issue.

Seriously,  glad you survuved - and with so few things wrong.  Broken bones take a while to heal.  Hope the process is fast with few complications.  Good thing the guy stopped.  Citation helps your case.

Hope the foot heals soon, the bike gets fixed ant teh dude in the car has his insrance jacked up for a decade!

Wow, that sucks man, but luckily you were wearing good gear. Oxtars saved my left foot from more extensive damage.

If I have any advise to give you, it's get into physical therapy as soon as your doctor says you can. It will save you from pain and immobility later.

It's funny what people will say in an accident, I had someone back up and hit the SIDE of my work vehicle as I was driving by, and try and say it was my fault.

Bad to worse.  I found out the guy may have no insurance.  Which would suck.  Health insurance is covering the costs of the bones now, hopefully my pocket won't get hit for any of those costs and I had comprehensive so the bike is covered, except for deductible.  Wow, that sucks.

On a lighter note the pins in my foot come out two weeks early.

My guess is... if he can't afford insurance, he doesn't have much to take.  Bike is covered and medical bills should be covered, I went ahead and got the best health coverage I could.  I don't think there'll be much out of pocket.  Hopefully I could at least get that out of him.  Safe Auto said it lapsed in 06, I would think the officer would have noticed that on his card and cited and cite the guy for it.  Maybe there is a different policy.  Who knows?

In my opinion, those cards are worth less than the paper they are printed on.  People forge them all the time.  The industry needs to come up with much better 'proof' than a piece of paper - a national database or a card like a mastercard.

What kind of car was he driving?  If it was anything decent and he doesn't have insurance you should request the car.

Man!!  If I keep reading about all these nasty crashes I'm going to start ducking everytime I pass a car!  :(   Glad you are at least semi-okay.

I'm from that "socialist" [roll] country north of the U.S. so I need someone to enlighten me. 

On our policies here we pay a few bucks extra for a (now-mandatory) endorsement called "uninsured automobile" coverage.  If some idiot without insurance nails you that clause in your policy automatically kicks in and takes care of you.  You guys don't have anything like that?

I asked for under and un-insured.  But when they sent me the paper work I blindly signed the lines and now have neither.  My fault - none, since you should have your own car insurance.  Insurance companies should have to report lapses.  Still should have read what I signed my name to, but shouldn't need it I guess is what I am saying.

Well I went to the citation hearing for this early this week.

The stand alone witness and I had perfectly corellating stories and the accused mumbled about me switching lanes AFTER him and me going too fast.
So, he wanted the judge to believe that I switched lanes after him to GO AROUND him and a MOTORCYCLE was slower at changing lanes than an Astro van.  That and I switched lanes 3 times to go around him and had time do this at 80 while he was only going 30.

Well, what happened is the judge was already having a bad day and pissed and said, "Let the insurance companies sort it out.  I don't know what happened here.  Not Guilty."

So now something that would have been nice and simple is going to be a pain in my ass.

Glad you're mostly okay and hopefully you have a bike by the time the foot heals up.  [added]  just read the latter stuff - I truly hope you can get the insurance stuff settled, I think your witness and the daylight hitting this 80+ multiple swerving issue should at least put some holes on his rendition of the story.  Good luck with that.
