just got home from hospital. i will live relax!! takes more than a make the beast with two backsing dakota to stop me.

i had taken something to a friends house over on miller rd in midlothian. i am leaving his house and i see a van pulling out a few houses down. i stop and wave her to back up so that she can change the light to green when we get there. we get to the light both turning from miller onto 67 to go north having to cross the southbound side obviously. the light turns green and she starts through as do i behind her. the next thing i remember is laying on the pavement and my bike is running but sounds funny. i get up, shut it off and try to pick it up when i hear a crunch and pop in my right shoulder. i drop it back down because i thought to myself i dont know what i did but it just make the beast with two backsing hurt. a guy had put his hand on my back and i remember shoving him away as i stumbled around trying to regain my balance. i pulled my phone out called tina and then my buddy nick real quick. (btw tina beat everyone to the scene. shane said he didn't know a focus would go that fast.). i remember the guy that hit me asking if i was ok. i remember telling the paramedic to just pull my utag off for my medical info as i was getting into the ambulance.
according to tina the cop estimates the guy was doing about 75 when he hit me because his skids marks are 120 feet long before going into the ditch. the guy did have insurance and told the cop he ran the red light. the witnesses told the cop he ran the red light and that when he hit me it shot me into the air as high as a tractor trailer is tall. one guy told the cop that i looked like popcorn in a popcorn popper. the cop told tina i should be dead. by all accounts i landed on the right side of my head and my right shoulder.
the hospital treated me for minor concussion and "seperated and replaced" right shoulder. i could remember some of what the doctor asked but i couldnt remember it all thats why he thinks its just minor. he said the x-rays show obviuos shoulder damage but when i tried to pick up the bike it popped back into place.
the bike doesnt look to good. shane said its tracking all sideways. tons of cosmetic damage and leaking fluids. i just took a quick glance at it when i got home. i didnt want to look because i knew i would be pissed. regardless i am fine and just real sore. little headache but you know us marines we can be a little hardheaded.
will post some pics when i get time to take them.

That really make the beast with two backsing sucks...don't worry about the bike though..just get yourself healed and let the asshats insurance deal with all the bullshit (hopefully)...pm me an address and I will send Cars Suck stickers to ya if ya want...you earned em and proved the point all at once

just woke up from a pretty restless night. the only way it didn't hurt was laying on my back. i never sleep on my back so i was pretty uncomfortable even after the dope the doc gave me and two shots of "elixer". good stuff by the way. i am gonna go back to the hospital today to have my head checked out because it feels like my brain is pushing against my skull trying to break through. also got a bunch of swelling in both knees and my left foot.

finally got officials. they did ct scan, ct spine, x-rays on shoulder, pelvis, left foot, right knee.

doc said that i have bruises on foot, knee, pelvis. i have some torn muscle in shoulder but they won't know more on it until i get swelling down. the ct spine was negative for any fractured vertabrae. the ct scan showed no damage to my brain but it did show swelling. he said i have a moderate or grade 2 concussion which explains the swelling, loss of conciusness on scene and patchy memory about the immediate events when it happened.

tina is going to get disk for pics so i will post them tonight when she gets home.

thanks for the support. not sure on next bike. depends on what i get for mine and which route i want to go. i have looked at new 1100 evo's (monster of course) or maybe a monster 900,695, 620 AND a 900 supersport.

really sucks because i had finally gotten my bike to where i really wanted it. performance and appearance wise. my 695err is now the slowest 695 in the country. plus my favorite scorpion helmet, fieldsheer jacket, fieldsheer gloves, motocentric backpack and touring boots are all screwed up.

i also have already talked to the adjuster from his insurance agency and he said to get my medical taken care of and not to worry.

went by ams on way home and my bike is jacked. it don't look real good. frame, front forks, front tire, tank, bars, mirrors, rearsets, hand controls, headlamps, front master cylinders, exhaust and more just toast. it even scrathed up my .50 cal brass i used as frame plugs. i told jordan i want them back. a good friend gave me those.

I'm kinda amazed the moto doesn't look any worse than it does - I hope they are not finding any more physical damage to you C!

I think we've all learned two very valuable lessons here:

1. Glue a damn ultra strong magnet to the bottom of your bike to change lights for you ( my signal minder works good but some old speaker or motor magnets would probably do for you cheapskates ).

2. Never let anyone go first!   [roll] That was so unlike you Calscrazy, even for a neighbor, & even with the signal light thing.

the only issues now a few days later are loud noises and photophobia. whenever i first walk into bright light my head starts pounding real bad and i have to stop and cover my eyes.

it has been a looooooooong time since i was in an accident. the ins for the guy who hit me says there is two claims. the first is the bike and personal property and the second is the medical. does this sound right? i called two different attorneys and neither called back so my guess is i am on my own.

Two claims on the same policy doesn't sound weird; there was probably a vehicle claims adjuster and an injury claims adjuster.  THere will different deductibles, etc for each claim but none of that is your problem - the guy how hit you will be working it out with his insurance company.

What would be weird is if the two claims were with separate insurance companies.

Heads up, literally. It was close to 6 months after my wreck when I had my first Vertigo attack. Come to find out, I had knocked a few tiny bones loose in my right ear canal and they had run the loopy de loop and embedded next to some very particularly pissed off nerves.  It was terrible.  I had Benign Positional Vertigo for a solid week and the whole world rocked n' rolled.  I had an MRI and other testing done to insure it was nothing major, but it really makes you sick to your stomach.  Since then, I've had two more minor attacks and have learned to be cautious when tilting my head back and sideways at the same time (ex: grocery store top shelves, light bulb replacement, etc.)

Net: If you are pursuing a Uninsured/Underinsured policy claim against the drivers or your policy - DO NOT settle for at least One Year.  Things pop up.  Also, the current ratio of payout is 2X the value of all your medical bills (full cost). If particularly damaging it may go to 3X those medical costs. This covers your medical bills and your pain and suffering.

Also, if another medical coverage is currently paying your bills (ex: you do a co-pay), then that company will 'subrogate' and attach your eventual payout from the motorcycle policy. However, they only subrogate at the actual paid benefit to provider, not the total billed amount that you use as baseline for total medical bills.

Hope that is all clear as mud.

Did you have any after market parts? Do you have receipts?  They will pay on pipes, etc., so go for those financials.  Also, I had them pay on the sales tax too.

Also, include helmet, jacket, boots, etc., they may ask for you to ship them to them, but they will pay up to I think $1,500 for personal gear.

so they made their offer................$4800  [laugh]. i returned with mine. along with it i put examples of what another 695 is going to cost me. all the reciepts from my accessories. he fed me some kinda b.s. about limited policy. that means they only have to pay whatever nada value is. i kindly explained to him that will not work. i was told by an attorney and an insurance adjuster to notify texas insurance commision if they continue their hard stance to have a full investigation launched. then get attorney.

Shameful but it doesnt work that wat cj. You can do it one of two ways. Like tres and get an attorney right away or like i am and wait to see if i need one. I did find out that by law you cannot profit off of a propety claim. Since i am handling the property claim i dony have to pay some fool who is only interested in his own pocketbook. On the medical claim i do have an attorney that they have been in contact with. They say that pain and suffering should be 20% off total medical bills but the attorney said to go see me docs and let him worry about the medical BS. The attorney and a friends wife are helping me through the property claim.

Hi,

I handled my own claim.  I didn't go through an attorney and I got twice the medical costs.  Just keep spreadsheets on all your bills.  I did not relinquish my rights to manage my own claim and I did not cut an attorney (civil plaintiff) into my payout.  I'm really surprised they said you can expect 20% over your bills, considering I got 100% over mine. 

Whichever way you go, I wish you the best of luck and the least of aggravation.  And I never accepted the first 3 offers, but kept a very pleasant tone saying "lets settle this amicably."  The insurance company would rather not get their lawyers involved and would rather keep it at the Adjuster level.  As soon as the lawyers are called in, the insurance co attorny's bill internally against your potential payout.

Got the bike stuff settled but medical could be awhile. Havnt had dizziness in awhile. Headaches come and go. Some days are good, some are pretty tough. Been two days since my last one. Getting better! Hoping to show off new scoot next week if doc will let me start riding again.

i am having the seat recovered by bill's in arlington. gonna have some paint mixed for some touch up stuff. gonna have to pull left cover and repaint it where it has some battery acid drip marks. gotta get a right front turn signal, tank latch, and anit-rattle clip for the rear caliper. after that gonna do a maintenance on it or take it to stuart havnt decided yet. he will know if something is even slightly off that i may not notice. ride it for a few weeks then start hopping her up on some fcr's, 14/40 sprockets and flywheel!!

Did the doctors perform a MRI?  If not, think about thinking about getting one done - just to get the letter that says "his brain is normal"!

Had second round of mri's friday. Got results today. Brain is ok. Swelling is gone. Neck is good. Two bulging discs in lower back but i am not gonna have back surgery. Doc saus alot of people live with it unless it really bothers them. Mine isnt bothersome.

I have an L5-S1 (bottom of the back) herniated disc, it is only a problem if I aggravate it. For example if I pick something HEAVY up.........or get out of my son's Prelude. :-[

For the most part it is a non-issue for me. Once the swelling goes down after I have aggravated it everything is back to normal. When I do aggravate it immediate muscle relaxers really help.
