Title: Califoria C.A.R.B law
Post by: kendallb on June 20, 2013, 06:41:28 AM

Removing my charcoal filter this weekend on a early 2000's monster.

Anyone know any current specifics about the California CARB law regarding?

I've researched some documents from the website on it, but nothing for 2013(read somewhere else this was changed for 2013 for ex. no mandatory smog checks)

If i remove my charcoal canister, when and how would i be cited/ticketed if this is in fact illegal still?

Is this inforced at license renewal?

If i resell my bike, can i be cited/penalized for selling a non-compliant Carb vehicle?

In which cases, is the charcoal canister removal reversable?

Thanks everyone! I know, Cali sucks about these vehicle laws (understandable though).

If you do it right.... you can just put it back on when needed.

I agree.

I did however read(on another forum for a different bike) ..

that someone was pulled over for one thing, and also cited for his charcoal canister removal(violation of carb law, california)

but this was all circa 2008...

I've never heard of or seen another cop cite for the canister on a moto. I've cited for CARB violations on street racing cars but they were racing when I stopped them.

+1 ..^ this is good to know!!

Like bobspapa mentioned, i'll just remove it the right way. That way i can always put it back on if necessary.

Also, if a LEO wants to write you up he will look around for things to write you up for!

The fact is there is no 'School' for LEOs to become proficient at spotting CARB violations, especially on Motos. On a car that requires smog checks every other year, as well as cats, smog pumps PCV and a bunch of other stuff it is quite a bit more obvious. Even in my old Mustang, which had all of the emissions pulled off, I was cited for the moving violation, but he never asked to look under the hood. I wouldn't worry about it on a 10+ year old bike. There is no way for the LEO to know what should or should not be on the bike. There is no inspection when registering/selling a bike in CA, at least not for sub-2013 bikes.

There are actually moto specific training classes (or "School") for CA law enforcement. A couple of our guys went last year. There are also street racer specific classes.

I have found that a quiet bike does not trigger the need to check emissions.  When I bought my 2013 (2012 build so exempt from new laws) I did Zards (with DB killers) and a cannisterectomy.  Due to not getting a license plate for nearly four months after buying the bike I got pulled over quite a few times (nine) not one ticket not one question about exhaust.....

I admit I was surprised.  It is all about the noise and the jurisdiction.  Ride in San Diego County and I bet you get emissions tickets.  Their CHP office has a mandate to remove all the sport bikes from the roads.

The  twin Zards look pretty nice and no joke about them being fairly quiet.  I had a CHP with his window down right next to me at 75mph (65mph zone) and all he did was look over and smile, pulled over the car in front of me though!

I ride in San Diego County and have never been pulled over for emissions.  My last bike had an M4 slipon and it was pretty loud.  I got pulled over for speeding once and he didn't even look twice at the exhaust.  Never been pulled over on my Monster with Termis and I removed the charcoal canister well over a year ago.
