Well luckily, I was in my car and not on my bike. Lady pulled RIGHT out in front of me, the roads were wet but it wouldn't have mattered anyways. I had no time to stop. I had the truck towed to the Chrysler/Dodge dealer directly across the street so I will let them get it taken care of with Progressive.
My biggest worry is that my my Durango is a 99, but it only has 51,000 miles and is meticulously maintained. I hope they don't total it. The accident was just on the driver side front.

Yeah, it's bad when a great, but older car gets scratched by the insurer. Worse when you don't like the new models.

Some (most?) insurance companies will go ahead and fix a vehicle that they would typically consider totaled but that's only if you explain to them why you absolutely want to keep that car.

We were on the other side when my wife's car got swamped by a passing semi-trailer doing 80km/hr through a flooded area and destroyed the motor and swamped the interior. The repair bill was round the $14,000 mark and the book value on the car at the time was the same! And they repaired it! ???
Kinda wish they didn't. But in your case I hope they repair it....fingers crossed mate! [thumbsup]

Wow. My experience with a flooded vehicle led me to believe that any bit of water would automatically total the vehicle.

Me too, stank for months afterwards and the only electrical issues it has had is the MAF sensor which you could understand having so much water flow through it.
The car is cursed.........my wife hit a kangaroo bout a month after getting it back from the shop and they repaired it again!

Totaling it may be your willingness to accept used or aftermarket (Chinese) parts.
Post a pic and I can give you an idea of the repair bill vs. value. They have the right to scrap it at 65-70% of value, however, it is your vehicle not theirs. Also keep the term diminished value in the front of your mind.
You are the claimant and they have the responsibility to return the vehicle to preaccident condition. Make sure they do so. The shop will want to, the ins co will want to get off as cheap as possible, they will tell the shop, " we don't pay for this, we don't pay for that" all BS.
Wish I were closer, to help out. Make sure that if you have any pain you get checked out very soon, many issues don't manifest them self until later.

So I basically have 1000 bux from the claim that her insurance is going to cover. God I got screwed big time. Just found out today that for 11 dollars more a month I could have added comprehensive and collision. I guess I learned my lesson the hard way about insurance. Never signing up for progressive or any company online again. Here's a few pics I took. Oh I almost forgot, got screwed out of $220 to have the truck towed DIRECTLY across the street to the dealer. Ugh. Bad day.

Can't say enough about maximum limits on vehicle insurance. Hate paying the extra dough but anything above and beyond the minimum and they will come after anything you own for the difference.
I got in a minor accident that was my fault (tired and went straight at a left green arrow) the lady looked right at the logo on my truck and hit me broadside. Both of us from a dead stop to mid intersection. Yet, somehow despite no injuries on-site and damage we both drove away from she still managed to think it worth 300k. Her husband was not as bad; He only went for 15k for wait for it.......... Loss of Conjunctive Relationship. Needless to say she got damages and a few bucks for a chiropractor. luckily my insurance company managed to keep the payoff under my limits.
BTW she was deposed before I was and I felt fairly confident after my attorney informed me it was not going to end up costing me any money. Why did I feel so confident? He was laughing about how well her mouth worked when he deposed her. [laugh] [laugh] [laugh] [laugh]
Moral of the story? Buy as much as you can afford. If you assets, buy insurance for your insurance. There is always someone somewhere looking for a free ride.

You are the claimant, he company MUST return your vehicle to pre accident condition. Get in contact with them as well and see if you can't get a legal referral. Let her company know you're seeking legal damages. Keep a record of all calls and get first and last names.
That makes no sense. Her fault, her liability, she pays.

Uhh, yeah. You don't need collision if she's at fault. Her insurance has to fix your car to the same condition it was in before she wrecked it. Do not accept any money from her insurance company yet. They will try to get you to as that will close the case.

I didn't even call my insurance co.
First call I made, besides the police (they tried to drive away) was to their insurance co.
They hadn't reported the accident yet, so I had to wait for the ins. co. to corroborate my story with their customer, and then they took care of everything.
God my luck sucks. MI is a no fault state. So my insurance pays for my damages and here covers her (and my deductible). Boo

Her insurance still has to pay.
No fault has nothing to do with your collision claim. She is liable.

What you understand isn't correct.
Her insurance company owes you the full amount it takes to bring your truck back to the condition it was in before you hit her.
There is no deductible amount for you in this accident.
Whomever it is that is feeding you this information is lying to you, in order to keep more money in their pocket.
If it's the repair shop, find another repair shop.
If it's her insurance company, then you need to tell them that you are about to contact a lawyer, in order to get the amount you are due, unless they change their tune, immediately.
Oh, and mention that your neck, back, and shoulders have been stiff and sore since the second day after the accident, and you're about to start seeing a chiropractor, a masseuse, and your doctor due to the accident. That will make them work things out a lot quicker.

You might be surprised how close $1000 might get you to fixing that. I had similar damage + needing a radiator on my same generation Dakota and I had it fixed for $1400.

Bladecutter, I honestly thought the exact same as you when I first heard about how screwed I was. I have been to 4......yes 4 body shops and two dealerships, and they have all told me the exact same thing. It's 1 of many reasons I want to get the hell out of MI.
Oh, and every shop I've been to is around $2500 to fix. That's with paint though. So I might get it all fixed and ride ghetto for a few weeks. I planned on having the whole thing plasti-dipped matte black, even before the accident.

I had a shop do it. Repaired frame horns (where bumper attaches), straightened bumper mounts to re-align & attach bumper, replaced radiator, straighten & paint right front fender, replace entire headlight assembly.

Well I faxed the quote from the shop to progressive on Tuesday. Of course i haven't heard anything back yet. Going to give them a call tomorrow and see what the status of the mini-tort claim is. The shop told me I could get it all done for about $1200 not painted. So I may just do that.

Anyone giving you advice that states her ins company has to pay up is wrong. In MI, you are screwed. That's basically what it means to live in a "no fault" state. I know this because I experienced it. The "mini tort" is all you are entitled to from her ins company. Your own carrier supposedly picks up the rest.
Unless your company isn't licensed in MI...then you are completely and totally f***ed. Ask me how I know that...
This just keeps getting better! I just found out that if she doesn't carry the "mini-tort" coverage in her policy then I have to take her to small claims court for the damages. Would that even be worth it? >:(
Go to the hospital ER because of your sore back/neck. Inform the insurance company of your pain and intentions to pursue further treatment. They'll cut you a check for $500 immediately if you agree to accept that as your final medical settlement. That's pretty typical.
Really sorry to hear about this Dex. Same thing happened to me in MI 2 years ago and since my ins company isn't licensed there I was screwed.

Not 100% on this but I don't think the cops would or could do anything in this situation because it was private property. The guy even could have told you to go pound sand if he was a real prick. Hbliam may know for certain.

In CA on private property (like a grocery store parking lot) we don't have to take a report but the two parties are obligated to exchange information. If the at fault party leaves the scene than it's a misdemeanor hit an run (if only property damage) and the police will take a report as well as prosecute the offender.

I didn't tell ya to strap on a neckbrace and get in a wheelchair. ..just to have your inevitable soft tissue damage properly assessed. Which can take months upon months of chiropractic care and thousands of dollars...which the insurance companies know...and are happy to avoid. ;)
