Title: Down, But Not Out of The Spankins....
Post by: DucMouse the Mighty on August 03, 2008, 08:44:55 PM
well it finally happened  :'( i went down,an unfortunate accident. an older lady wasn't paying attention and make a left hand turn right in front of me. i tried to stop and ended up skidding into her front driver bumber and smashing my knee between the car and bumper...but luckily nothing was broken  [thumbsup] but i have a follow up with another doc to see if i torn anything  :-\ which i hope not.....other then that just brusies up my left side...oh and i was in full leather gear..all i have to say is thx god  [laugh]

but as for the bike...well at first sight very little damage, just scrapes on the forks little ding in the tank, ripped off the tail light....but no scratches on the TI pipes  :o which i was super surprized, bent the bars..my bar end mirrors stayed on,levers perfect.....but then when i took it to the shop....my steering stopper was cracked. since its part of the frame they will total it  :'(

now the worse part is dealing with the insurance company! the lady said she was all at fault and she claims she didn't see me..she told the officer that....i think the only thing i didn't do ( think i was high off the adrenaline) was getting info from all the witnesses  :-\

umm...i never had to really deal with this before, so if u guys have any advance i would much appreicate it  :)

thx
Miss "Gimpy" Mousey

Get well soon hon! Stay off that leg. If the bruise stays bad, you'll want to make sure it doesn't clot up too bad. I'd suggest a heating pad after a couple days to get the blood moving. But I'm not a doc, just a CNA.

glad you're good mouse. [beer]

as for the insurance/police report/ etc....

never admit or hint at guilt of any kind

if it goes to court.
1) never be apologetic, as that can sound like guilt when their lawyer throws it back at you
2) stick to the facts as you know them. let your lawyer discuss other witness information
3) be humble, but confident (if that makes sense)

Good luck on a speedy recovery.

Like a pilot might say, any accident you can walk (limp) away from is a good one.  No doubt kudos to you on some skillful responses in a scary situation that could have ended worse.

Hay!  Holding ice and rubbing *gently* with cold hands can feel nice, and for the first few days doesn't promote swelling like heat.
Glad you're still whole!  Post stories, dreams, gripes; if you need anything, that's wut us innernet supporters are for!

Oncoming cars making a left are almost always at fault regardless of whether or not they saw you. As was stated before, don't admit to any fault at all.

Here's hoping you recover quickly and well and that you don't get stiffed for the cost of your bike. If you can, see if you can get the shop to let to swap/take some of your aftermarket goodies that are salvageable before it gets carted off. At least take your tool kit from under the seat.

Cold beverages on the bruises to keep the swelling down and the spirits up.  DON"T let them cart your bike off yet, if it's just the steering stop you may be in very good shape.

Sorry to hear about your crash. I´m glad you made it out alive and well. Make sure you get a second and third opinion.. i did and they´ve found broken muscle fibres on my left gluteus and some seriously contracted back muscles. This is 2 months after the crash.

Mousey! So sad to hear about your bike. Glad you were able to leave the scene under your own power.

Just give your insurance company the case number. They'll get all the witness reports and citation records and all that for you. My insurance company will even pay me for the vehicle and then go after the other person's insurance company for reimbursement. But they'll pay me first to get me back on the road fast. Hope it goes that smoothly with you.

Good luck with it.  [thumbsup]

but i will end up buying it back for 1200 and selling it to a friend to use as his project..so Trent will have a good home ;D

now that i got that part semi-settled....

the knee is doing better,i went o go get an MRI and the ortho doc didnt think i needed one...he says i just bruised and banged it pretty good...what a lucky bastard i am.....
but i still have pain :-\

now im trying to get everything in order with medical and im going to settle this on my own, save money on not having a lawyer...so far her insrance has not made an offer yet. im not surprized cause she wants to make sure we get all my treatments and whatever taken care of first...then we negotiate [evil] get as much as i deserve and get a name SPANKTASTIC MONSTER

so now my hunt has begun....what do i get next  [evil]

They will try and hold out for as long as possible.....  the longer you have to heal, the less they can have to pay.  They have two years to either reach a settlement or you file a lawsuit...  You may want to have a lawyer look over it, or if you have a friend thats one, even better.  I got a bit screwed when I handled mine, even with professional help.

Good Luck.

And demand a MRI, I had one on both my knee and back after the doctor told me I was fine... and two weeks later I had knee surgery.  [laugh]

Knee pain can stay with you your whole life... its five years after the fact, and mine bother me every day.

Make sure you are properly treated and compinsated.

i have talked with a couple of lawyers..im just waiting to see what she is going to try and do....

either way i play to settle with future medical(just in case the find something later and they can pay for it) or get a nice lump sum and be happy with a new baby...but i have a couple more weeks to get my game face on and shit together and present my case  [laugh] either way if she wants to fit me i can get a laywer,it was totally the other ladies fault and going to court for it! so either way i think im a weiner [laugh]

Ok, fine  [roll]  I retract my suggestion of 848 and suggest instead a Vespa.  You should have no trouble fitting on that [laugh]

You can lower a bike, and get a thinner seat.  I know a guy that had a 27" inseam and he rode a 1000rr.  He lowered it and I cut his side stand shorter for him.

And for the record, and 848 is a monster, just not a Monster.

Be careful taking a lump sum. It may make you ineligible for coverage (from your medical insurance provider) for the same problem in the future.

I think the Sport Classic would pose the same problem as the 848: too tall.

I've got a 36" inseam and I've got about 3" of clearance on the seat.

But if she could get one to work, people would think she was on fire cause she'd be *smoking* hot on one.  ;)

The solution:
