I might want to wait till after your 6 weeks of PT to see how you feel before signing off on the medical thing.  But that's just me talking.

I want to know how they price your bike. Will they give you enough to buy a brand new one if you had an old one? How is that work?

I expect they will give me $3000-3500 if I am lucky.  I will NOT get enough for a new bike.  However, they should give me between $5-10k to sign my medical waiver...(and I am actually fine, my Dr gave me the delux treatment because she knew it was an insurance thing).  With the waiver money I will be able to easly get  a new bike.  Probably, a "new old stock" S2R.

+1 on that -- In your shoes I'd want this behind me too, but until those aches and pains subside, you're really not sure you're out of the woods. It's fantastic that the thorough testing you've had so far has come up good, but it's trying to prove a negative & can't be 100% (or even 90%) certain at this point. It's not about being litigious or looking for a big payday -- when it insured this kid, Geico took on the responsibility for making things as right as possible with people he hurts, and you need to make sure to a higher degree of certainty you know just what you're dealing with. Give it a week or two at least.

Hey!!! that is cool man!! You are getting a new bike! that is the only positive thing about your accident.. it already happened .. so I would look on the bright side... you SURVIVED.. and WILL have a NEW BIKE< .. haha.. I think that's great! COngrats!

Sweet.  And Geico owns Cycleguard so they're not ignorant as to the touchless accident causes. That's the worst - you can bust your ass to avoid something that would have been an outright smash-up in a cage, but if you AVOID a collision proving fault when you go down is supposed to be a nightmare.  It's in their best interest to settle and they'll probably try to sell you a policy in the closing!

hope it all goes ok man but what I've heard is that insurance companies are absolute pregnant doges to deal with when it comes to pursuing a claim where there was no actual collision between yours and their client's vehicles and that they'll weasle out of it any way they can.  Definitely interested in your outcome. 

luckily the police report is apparently in your favor so hopefully that helps.

Try to get an offer settlement offer from them in writing before you go to a lawyer.  That way you can tell your lawyer you will only pay him a percentage of whatever he gets in excess to the offer you had before consulting him as opposed to giving the lawyer a percentage of the whole thing.  No matter how nice the claims adjuster is to you, don't sign anything!  Don't rush the gun until your treatment is complete or YOU WILL regret it!
