Acting lawfully and killing someone is right or OK? There should be no penalty for that? You have claimed that the police are extremely well trained. It's escaping me how that could be true based on this incident.

Killing someone can be lawful, yes. Did these guys do the right thing? Obviously not. Is it criminal? Probably not.

The police are human, even the well trained ones.

We'll have to disagree about how killing an innocent person can in any way be 'lawful'.

To err is human...killing some one that didn't 'deserve it' is criminal. Whether it's a LEO or a regular citizen there needs to be a price paid for that IMO. It's an act that can't be dismissed. The fact that our society can dismiss it is disturbing to me.

You won't change my mind on that.

Torrance police say the man was driving a pickup resembling the fugitive's. The incident happened just after the LAPD fired on women delivering newspapers nearby.

David Perdue was on his way to sneak in some surfing before work Thursday morning when police flagged him down. They asked who he was and where he was headed, then sent him on his way.

Seconds later, Perdue's attorney said, a Torrance police cruiser slammed into his pickup and officers opened fire; none of the bullets struck Perdue.

His pickup, police later explained, matched the description of the one belonging to Christopher Jordan Dorner â€" the ex-cop who has evaded authorities after allegedly killing three and wounding two more. But the pickups were different makes and colors. And Perdue looks nothing like Dorner: He's several inches shorter and about a hundred pounds lighter. And Perdue is white; Dorner is black.

  I'm having a really hard time with this. I keep putting myself in that truck.
  I'm a concrete contractor and I'm often in neighborhoods that I'm not  familiar with . The scenario goes like this. It's 4am I'm driving slowly looking for the job sight I set up the day before. All of a sudden I'm under a barrage of gun fire. At this point the absolute best thing for me is to get hit and lose consciousness. Because if I don't my life as I know it will be over.
All I know is my life is in danger.  I draw my weapon and return fire at my attackers. Thus "validating" the police use of deadly force. And if by some luck I actually hit and killed my attacker, I'm now a cop killer. I'm going to jail forever or going to be shot dead. All because someone didn't do his job and positively identify a suspect.

Kind of hard to say that the officers involved in this second episode didn't act in a criminal way.  The first occurrence of engaging the wrong vehicle had to have gone out on the radio, and there is no way that people weren't told to tighten their shit up.  Plus, the guy had just been stopped and cleared. 

And yes, while this can easily be construed as monday morning quarterbacking, it more comes down to having a sound understanding of acceptable training and tactics, which these guys obviously didn't have going for them.

There is a huge difference between mistaken identity and failing to identify.  Regardless of the facts available this is already being spun.

If this guy had gone out and killed Joe Blow and his girl Jane and then sent letters and posted on fb how he was going to kill all bakers, cupcake makers, and such there would be vastly different police response.

Even being an ex-cop would not make a difference in the above.

Instead, he went after them and their family.  The police are jacked up and ready to get that sob cop killer, traitor to the badge.

It is a sad situation all the way around. Innocent people getting shot up, cops are going off on pure adrenaline. And lets not forget that this guy sounds like he needed some mental health help and did not get it.
