Ok...so I am still full of adrenaline (just happened)...bear with me.
Riding home from about a 40 mile round trip. 2 blocks from my street. Quite residential street 35mph posted. 3 way intersection (turn on my right). No stop signs.
3 cars bunched very very tightly, traveling toward me. (I am under the speed limit maybe 30mph). Last car decides he can make the turn in front of me. Speeds up and starts to execute the turn EXTREMELY early (4-5 car length before the corner) with no signals on. He is trying to dive underneath me. I swerve and miss him. Lose the rear end, catch the left peg and I am over the top. Bounce on my hands and elbows, roll on back and stand right up.
I seem fine...little blood on pinky. Gloves and jacket do their job perfectly. THANK YOU ALPINESTARS.
Cops come. [leo] No tickets but a report that should read it is his fault. BTW...other driver...17 years old. [bang] He disputes nothing about my discription of events to the police. Although he did say he did not have a cell phone (he did produce one later) and he did try to flee the scene...but was easy enough to convince to stay. (I can be fairly intimidating)
This literally happened about 30 -40 minutes ago...sorry about the disjointed writing style.
I am going to take some Advil and drink some whiskey now. Thanks.
Sorry to hear about this.
I am glad the cops were there to get a written report.
That driver sounds like he needs to go back to school >:(
So wait....you scraped the peg as the back came around, then got launched??
-That blows dude, sorry to hear about it..... Glad to hear you came away pretty unscathed!! [thumbsup]
-How's the bike looking??
+1
Glad you're ok.
Other guy have ins?
Glad you came out of it alright, any broken bones or other serious injuries? You are in for some serious soreness soon.
What is the insurance situation? How did the bike fare?
What a way to spoil a nice short ride. Glad you seem to be pretty ok. If it hurt the bike I might have been inclined to kick him in the ass and ask him what the hell he was thinking.
Yeah, I am gonna be sore....feel it coming on already...and I am drunk now.
Bike. Left peg gone. Shifter bent (medium bad), rear turn signal gone, dash mounts broke (kinda broke already though), very minor rash on right exhaust mid-pipe, left exhaust very slightly out of alignment (not noticeable), bars and all controls all outta whack, rash on bar slider and hind sight mirror, new tank dent and paint chip...that seems like most of it. Probably some rash on the fork but I haven't checked for it yet.
Shoulders starting to be sore. Definite hot tub tonight. Whiskey will be liberally applied also...maybe some left-over Vicodin too. [drink]
got the other guys insurance...hope police report reads well ...
Can't believe he tried to leave the scene....what's up with people???
Sorry to hear about your accident, take it easy, hope you heal up soon. Good luck with the insurance and bike repairs.
shit man, i'm really glad you're ok. with those other two cars in pursuit, it could have been much worse :-[
as a recent victim of a hit-and-run i know how you feel, man. i chased my offender's ass down and in the end got a freshened-up bumper for my efforts. people are sickly little animals with no sense of duty.
Dude. post the other driver's name and i bet some folks can organize a "driving class" for him at home.
Just finished singing the kids to sleep...I suppose that is the good news. :) Even with wrist soreness can still play guitar and sing 8)
THANKS EVERYONE for the well wishes!
I will keep you posted about how Geico treats me.
It was clearly his fault...other driver was 17...and tried to flee!
I am pretty drunk and about to get in the hot tub [thumbsup] (hoping not to drown)
Glad your up and typing....
Hope you get n your ride soon [thumbsup]
It is way to often I hear, "and then they ran" pisses me off >:(

that is hilarious 8)
Sorry to hear this..glad you are ok! But.. how did you manage to NOT kick his ass right then and there? I've never been down.. but if I have a chance to get to talk to the guy who almost kills me.. I am pretty sure that I would lose it..
That will ruin a good day no matter who you are.
Glad you weren't seriously hurt.
sorry dude, i ve been down bad and it sucks. good job keeping your cool. i once knew a guy who got hit by a person who went through a red light. he ended up beating up the dude and my friend went to jail. the accident wasn't his fault, but he ended up paying in the end. glad you are alright [thumbsup]

He went to jail? what happened? Did he have to pay a fine for beating the crazy driver? won't the judge cut you some slack since you were hit and your life was put at stake... I am trying to learn so I don't make a mistake when the inevitable happens to me.
FYI GEICO gives money for damaged helmets. I got full purchase price for mine.
Glad to hear things are not worse.
Bummer dude..... the bike can be fixed, you're harder to work on glad you're ok.

I came damn close to doing this myself after a cager hit me other interstate once. Cop and firefighters showed up just as it was getting heated.

I'm not sure. I don't have GEICO anymore, and I never saw it in my policy when I did, but after I wrecked the s2r, one of the claims guys I spoke with mentioned it to me. They sent me the form and a mailing address, and I shipped my helmet to them. They sent me a check for the full purchase price.
Glad to hear you're alright. [thumbsup]
I'm sure you're prepared, but expect to wake up feeling like you got in a fight. I know I did after my accident.
Hope everything works out with the [leo] and the insurance.

That phenomenon seems to be the norm when you leave a moving motorcycle.
Holy Crap! Glad you're OK (although you don't really have to high-side as an excuse to get drunk & sit in the hot tub ;D )
Sounds like you handles it well, that your mostly OK & the bike is fixable [thumbsup]
Glad you're alright, you seem fun & funny. Good luck with the aftermath.

The fact some guy hits you with his car isn't an excuse to beat him as far as the law is concerned. (some of the lawyers here can chime in if they want). I'm pretty sure, as far as the law is concerned you aren't defending yourself at that point because the threat has passed at that point. It'd be like claiming self defense for shooting someone in the back a minute after they punched you. Doesn't work that way.
sorry to hear about your accident, sounds like you did the right thing though in the circumstances.
I am curious, how did the rear wheel come out from under you when you were swerving?

yeah, you'd have a lot of explaining to do.
a good lawyer could probably keep the crim charges to a minimum arguing you were out of your mind, but the fact is, you're in for it if you react that way.
Glad your basically ok. Did you lock the rear? Which way did you swerve, left into oncoming traffic or did you make the right turn at the T intersection?
Thanks again for all the concern and well wishing.
Man I feel like sh*t this morning. To answer some of your questions.
1. Yeah. I wanted to kick his arse just as bad as you would have. However, I spent 10 years of my life training pretty much daily to be able to control my responses and emotions in high adrenaline situations. So while pounding this 17 year old into a puddle was on my mind, I realized it would not help me get a new bike and I focused my attention on what would help me get a new bike instead.
2. I locked the rear wheel...though I didn't have enough time or room to do much about it...which is how I lost the rear end.
3. I swerved left into the on coming traffic. This was pretty calculated though. I could see about 400 yards down the street and their was no on-coming traffic. Had I had enough room to properly execute the swerve (without all the severe braking) I would have gone around him. He was making the right at the T intersection so turning that way would have had me still in his line and probably caused a collision. I was really just trying not to hit any cars. I figured a dismount was gonna be ok at that speed as long as I didn't hit a car or get run over.
Other thoughts.
Gear that worked. Alpinestars SPS Gloves, Alpinestars AS Stages Perf. Jacket. Both worked great. I was also wearing Aria Profile, Shift kevlar jeans and Alpinestars boots but they did not take any real punishment. lesson...GEAR UP. [thumbsup]
I have a fair amount of training in "slowing things down" in high stress situations and even at just 30mph....this happened very fast! I did have time to analyze my escape route but not enough to even release a locked rear brake. I have raced in the SCCA and instruct high performance driving and race licensing and spend a lot of time at the track (in cars). I probably see several accidents every year and am personally the car for 3-6 spins or off track excursions (in students cars)...and this still happened very fast. I have seen sand pits and guard rails coming at me fast but this was really quick. Whole thing couldn't have taken more than a 1-3 seconds. Very little reaction time.
that stinks. glad you're ok...how much does the whiskey have to do with how you feel though? [cheeky]
i had a kid jump out into the road at me and it scared me enough to lock the front wheel. i got up and chased him to a convinience store where he was begging for help and scared shitless. i walked over to the cop sitting in the parking lot and explained what had heppened. that kid's family and the families of the other 2 that were with him got deported shortly after that. (they lived in the same complex as i did)

i bet he got his ass whipped when they got home to their 3rd world backwater...
Amazingly not hung-over this AM. Pretty damn sore though...neck, shoulders, wrists.
I would like to have this kid deported...but he's from here...still if I could send him to some third-world backwater that would be great.

idk about 3rd world backwater...they were irish.
Talked to Geico rep and made "recorded statement". Made sure to use the word illegal several times and mention I am going to Dr. tomorrow. Spoke with the drivers mother...who seems fairly normal...(he is in trouble).
I should hear more about the claim tomorrow.
Good luck and speedy recovery. [thumbsup]

some parts of ireland are pretty backwater.
Speedy recovery, RD, and congrats on your good reflexes.
As for the driver, possibly the best outcome (aside from a lot more legal ramifications than it sounds like he's facing :() would be for the memory to haunt him forever of the day he ALMOST killed someone, and for him to remember it with dread every time he gets behind the wheel.
Went to Dr. today.
CT scan of neck and upper thorax
xray of both wrists and right ankle
physical therapy X 6 weeks
Vicodin and Flexeral...and plenty of them.
I'll keep you all posted.
No new word from his insurance company.

Do you have health insurance to cover all the medical bills? That is going to be expensive.. I hope you do, [thumbsup] [thumbsup]
Yeah, I got insurance if his isn't gonna pick up the tab.
I really hope they are gonna pick up the tab though.

Wasn't he cited in the incident?
If he was his insurance should be involved. Have you contacted them with his policy number?
Give the kid a call and threaten legal action if you don't hear something soon. Should scare him enough ;)
His insurance (Geico) is stepping up to the plate...totaling my bike (picking up tomorrow) and paying me to sign medical waiver. ;D
Hopefully I will have a new monster by the end of next week.

I might want to wait till after your 6 weeks of PT to see how you feel before signing off on the medical thing. But that's just me talking.
I want to know how they price your bike. Will they give you enough to buy a brand new one if you had an old one? How is that work?
I expect they will give me $3000-3500 if I am lucky. I will NOT get enough for a new bike. However, they should give me between $5-10k to sign my medical waiver...(and I am actually fine, my Dr gave me the delux treatment because she knew it was an insurance thing). With the waiver money I will be able to easly get a new bike. Probably, a "new old stock" S2R.

+1 on that -- In your shoes I'd want this behind me too, but until those aches and pains subside, you're really not sure you're out of the woods. It's fantastic that the thorough testing you've had so far has come up good, but it's trying to prove a negative & can't be 100% (or even 90%) certain at this point. It's not about being litigious or looking for a big payday -- when it insured this kid, Geico took on the responsibility for making things as right as possible with people he hurts, and you need to make sure to a higher degree of certainty you know just what you're dealing with. Give it a week or two at least.
I'm pretty sure I'm ok...but I'll wait a couple weeks.
Thanks.
Hey!!! that is cool man!! You are getting a new bike! that is the only positive thing about your accident.. it already happened .. so I would look on the bright side... you SURVIVED.. and WILL have a NEW BIKE< .. haha.. I think that's great! COngrats!

Sweet. And Geico owns Cycleguard so they're not ignorant as to the touchless accident causes. That's the worst - you can bust your ass to avoid something that would have been an outright smash-up in a cage, but if you AVOID a collision proving fault when you go down is supposed to be a nightmare. It's in their best interest to settle and they'll probably try to sell you a policy in the closing!
Good luck, etc.
hope it all goes ok man but what I've heard is that insurance companies are absolute pregnant doges to deal with when it comes to pursuing a claim where there was no actual collision between yours and their client's vehicles and that they'll weasle out of it any way they can. Definitely interested in your outcome.
luckily the police report is apparently in your favor so hopefully that helps.
hope it all works out ok, i´ve just started my own saga with the bike. good luck.

QuoteDUDE!! do you have a lawyer? if not.. get one.... asap!
Try to get an offer settlement offer from them in writing before you go to a lawyer. That way you can tell your lawyer you will only pay him a percentage of whatever he gets in excess to the offer you had before consulting him as opposed to giving the lawyer a percentage of the whole thing. No matter how nice the claims adjuster is to you, don't sign anything! Don't rush the gun until your treatment is complete or YOU WILL regret it!
