Probably different in the States, but In Belgium insurance mostly rules "if you avoid the car and fall down it's your own fault, while if you can't avoid it and hit the car, it's their fault." My uncle had this kind of accident once with his car, managed to avoid the other car, but ended up hitting a big concrete flowerpot. Insurance said: "your own fault". make the beast with two backsed up world if you ask me.

Good point, pretty much the same in NY if there is no vehicle contact unless the other party admits fault or you have some good witnesses.
