Mark Stenberg of Lawstop fame has replied to the 'how long is a piece of string' question by referring me to his web site and this is what I found;

Are you allowed to Lane Split?


In NSW you are allowed to pass a vehicle on it’s nearside if you are indicating left and turning left in the same lane or if you are on the left side of a broken or an unbroken line such as in an adjoining left lane.

You are allowed to pass on the offside if indicating right and you are on the left of either a broken or unbroken line in the same lane or on the right side of a broken line in another lane or overtaking. In other words if the lane is wide enough for you to share with another vehicle you can legally pass on it’s right side if indicating.
However, ARR (Australian Road Rule) 140 says do not overtake when unsafe.
ARR 144 says to keep a safe distance when overtaking.
Does it matter whether the vehicles being passed are moving? No

in victoria at least, there is no law specifically making lane splitting/filtering illegal, as long as:

- you pass to the right of a vehicle, within their lane, so as not to cross the line and become 'to the left' of the vehicle in the right lane (assuming 2 lanes of traffic)

- you have your RHS indicator on.

the laws relating to this manouvre are (cant remember the specific ARR numbers):
you must not overtake unless safe to do so,
you must not overtake too close to another vehicle.

problems there in - WTF is too close? there is no defined distance. i figure if i make it past without cutting off the other vehicle or hitting them, it was by default safe ;)

But generally when splitting up the middle of two lanes, you will be in and out of both lanes... no one is going to leave you enough space on the right hand side of their car

I do.  When I'm caged and I see a  [moto] splitting up the queue behind me I move as far over as I can for em.  But then I'm a bike rider in a cage, not a car driver as such, eh.

Road laws are different in each state so it depends where you do it.

Often there isn't a specific law relating to lane splitting but they use the " unsafe driving" or similar law to whack you with.

I generally don't lane split as there isn't often the traffic to justify it in Tas given I don't commute.

Again, the NSW Rules: 144   Keeping a safe distance when overtaking

A driver overtaking a vehicle:
(a)  must pass the vehicle at a sufficient distance to avoid a collision with the vehicle or obstructing the path of the vehicle, and
(b)  must not return to the marked lane or line of traffic where the vehicle is travelling until the driver is a sufficient distance past the vehicle to avoid a collision with the vehicle or obstructing the path of the vehicle.

As to the original post - I agree the ad was pretty distasteful, thankfully they pulled it, presumably acknowledging their mistake.

The ad was pulled because our (NSW) Motorcycle Council (MCC) insisted it be pulled, two [thumbsup] to the boys and girls that do the hard yards for us at MCC.

a couple of things.first and foremost MARK STENBERG is a LEGEND.he got me off my speeding fine (no not on a monster) but that other bike.the man can ride and he is one of the nicest guys to talk/ride with not to mention a true professional.
last but not least people do not winge about dickheads on the roads back home because im here in malaysia and they are all f#cked on and off the road.....pigmy
